Terms of Service

These Terms of Service (the “Agreement”) govern the relationship between you (the “User”) and Bitlink GmbH, developer of the mobile application xAlert (the “App”). By installing, registering, or using the App, you confirm that you have read, understood, and agree to these terms. If you do not agree, do not install or use xAlert.

1. Distribution & Subscription

1. 1.1. The App is distributed only through Google Play (Android) and the App Store (iOS).
2. 1.2. All paid plans (the “Subscriptions”) are purchased and billed exclusively through the respective app store. Payment, refund, and cancellation terms are governed by Google Play / App Store policies.

2. Registration & Account

1. 2.1. The App can be used anonymously—no sign‑in required. Projects are stored locally; deleting or reinstalling the App or resetting the device may permanently erase them.
2. 2.2. You may optionally sign in with a Google or Apple ID. In that case, projects are synced to your cloud account and can be restored on another device after authentication.
3. 2.3. You are responsible for keeping your credentials confidential and for all actions performed through your account and device.

3. Data We Process

1. 3.1. We collect no personal data except what is technically necessary:
   • device type, OS version, internal app identifier;
   • URLs you add—stored in an encrypted database for monitoring purposes.
2. 3.2. Data is not shared with third parties except as required by law.
3. 3.3. For details, please see our Privacy Policy, which forms part of this Agreement.

4. Acceptable Use Restrictions

You agree to:

• not add URLs containing illegal content or malware;
• not use the App for spamming or DDoS attacks;
• not decompile, reverse engineer, or modify the App;
• not bypass the app stores’ payment systems.

Bitlink GmbH reserves the right to suspend or terminate access for violations without refund.

5. Intellectual Property

1. 5.1. All rights to the code, design, logos, and content belong to Bitlink GmbH or licensors.
2. 5.2. You receive a limited, non‑exclusive, non‑transferable license for personal use of the App.

6. Service “As Is”

The App is provided as is without any express or implied warranties. We strive for stable operation but do not guarantee error‑free or 100 % availability.

7. Limitation of Liability

To the extent permitted by law, Bitlink GmbH is not liable for indirect or consequential losses. Total liability is limited to the amount you paid in the last 12 months.

8. Changes to This Agreement

We may update this Agreement. Material changes will be announced in‑app or via email. Continued use after changes take effect constitutes acceptance.

9. Termination

You may delete the App at any time. Bitlink GmbH may terminate access for violations of these terms.

10. Governing Law & Disputes

This Agreement is governed by the laws of the Federal Republic of Germany. Disputes shall be resolved by the competent court in Berlin, unless mandatory law requires otherwise.
